- In a rare acknowledgement of deforestation concerns, Deputy Prime
Minister Sok An, chairman of the National Commission for UNESCO, said
the widespread clearing of forests around Angkor Wat was harming views
of the historic temple complex.
Sok An made the remarks in Siem Reap at a Plenary Session of the International Co-ordinating Committee for the Safeguarding and Development of the Historic Site of Angkor (ICC-Angkor) on Wednesday, and stressed that the forest, known as Phnom Kulen, was degraded and needed immediate attention.
“I’ve known that Phnom Kulen is endangered now, thus this plateau region needs urgent protection,” he said, calling for a halt to all forest clearing which “affects our view of our national park”.
Sok An also called on Siem Reap provincial governor Sou Phirin to co-operate with the APSARA Authority and UNESCO to protect the national park.
Council of Ministers spokesman Phay Siphan said that the Phnom Kulen issue was on the government’s radar.
“In the meeting, we’re paying attention to Phnom Kulen,” he said. “It’s becoming an endangered place.”
According to Siphan, talks are ongoing about problems posed by both flooding and groundwater fluctuations, which are thought to be causing some temples to sink, which in turn causes structural damage.
“We are still discussing surface water, and we have to make sure that there’s no flooding in the temples and Siem Reap city,” he said.
In September the Italian government donated $200,000 to repair an embankment and stairway in the temple’s moat that were damaged by floods.
Angkor marks its 20th year on UNESCO’s list of World Heritage Sites this year, but, due to the national mourning for King Father Norodom Sihanouk, who played a key role in Angkor’s addition to the list, anniversary celebrations will be postponed until the World Heritage Committee meeting in June.

- A now defunct Australian firm signed a more than $100 million contract
for hundreds of thousands of hectares of land claimed by a Cambodian
company through a highly suspicious deal in 2008, according to documents
obtained by the Post.
The opposition Sam Rainsy Party raised the deal in parliament yesterday as yet another example of how a shadowy trade in economic land concessions has emerged due to a lack of transparent government disclosure.
SRP party whip Son Chhay pointed out yesterday that the only official fees paid for such ELCs were minuscule amounts of stamp duty, an investment that appeared to have netted original grantee P.C.Co Peanich Ltd $112 million for 350,000 hectares of land in Stung Treng province that was supposed to be for development.
But there is no evidence that the original ELC was even granted, and Stung Treng provincial governor Loy Sophat said yesterday that the government had never given the land in Stung Treng to a private company.
“And I don’t know why they have the contract on the paper, as I am an authority here – I have never known anything [about this]. I don’t know where that paper came from,” he said.
Sophat said the land remained in state hands and was not up for development.
A copy of the contract, which is not signed by any government body, provided by Son Chhay shows Australian firm Prestige Finance & Investments Pty, Ltd, which is listed by the Australian Securities and Investment Commission as deregistered, as having signed for the land.
ASIC records show the Australian firm, which had a list of unspecified officeholders and other roles made up of eight Vietnamese-born individuals and one Israeli in 2010, was deregistered on June 20 the same year.
The contract lists the company representative as Hannah Nguyen or Tong My Hanh, who ASIC records show owned $3,000 worth of the firm’s total $10,000 in stock while it existed.
After the sitting, Chhay said CPP lawmakers had refused to come clean about the details of this deal and others, declining to answer such questions as to why it appeared the previous lease holders of the land had illegally speculated.
“They commit wrongdoing, and when the government have not acted or have not done anything about it, I think they are somehow involved with wrongdoing.”
“So this is something interesting, so the question is who owns this land now? The government has to respond to my question. I am still waiting for Mr [Deputy Prime Minister] Sok An to respond to this,” he said, adding he had first made inquiries about the case nine months ago.
CPP lawmakers remained mum yesterday on specific cases of questionable ELCs raised by Chhay, instead talking more broadly of the government’s “leap frog” (step-by-step) development strategy.
Nicolas Agostini, a land expert at the rights group Adhoc, said the stated goal of ELCs as a driving force of development could not be achieved unless all relevant documents were made publicly available.
“They have to be consistent; if they claim that ELCs are for the development of Cambodia, then the development has to be transparent so they have to disclose all information,” he said.
“Also, given the moratorium that was announced in May, we have been told that some ELCs have been granted since the moratorium, and we have been told we cannot be told how many more ELCs are in the pipeline.”
Prime Minister Hun Sen set that moratorium on new ELCs amidst swelling public outrage about rampant land-grabbing but included a clause which allowed concessions already under consideration to still be granted.

លោក សុន ឆ័យ បានថ្លែងថា៖ «វាមិនមាន ន័យថា យើងមិនចង់ខ្ចីប្រាក់ពីបរទេស ដើម្បីអភិវឌ្ឍប្រទេសទេ ប៉ុន្តែ យើងត្រូវធ្វើការសិក្សាឲ្យស៊ីជម្រៅ ចំពោះការខ្ចីប្រាក់ ដើម្បីចៀសវាងកុំឲ្យកើតមានបញ្ហាទៅថ្ងៃក្រោយ»។ លោកបានបន្ថែមថា គណបក្ស សម រង្ស៊ី មានមន្ទិលថា លោកនាយករដ្ឋមន្រ្តី ហ៊ុន សែន និងលោក គាត ឈន់ រដ្ឋមន្ត្រីក្រសួងសេដ្ឋកិច្ច បានឆ្លើយខុសគ្នា អំពីចំនួនប្រាក់ដែលកម្ពុជា បានជំពាក់បរទេស ដោយយោងតាមរបាយការណ៍របស់លោក គាត ឈន់ ដែលផ្ញើមករដ្ឋសភា បានបញ្ជាក់ថា ក្នុងឆ្នាំ២០១០ រដ្ឋាភិបាលជំពាក់ប្រាក់ ៣៤៧៧ លានដុល្លារអាមេរិក ក្នុងឆ្នាំ ២០១១ ជំពាក់ប្រាក់ ៣៩៨៦,៦ លានដុល្លារអាមេរិក និងក្នុងឆ្នាំ ២០១២ រដ្ឋាភិបាលជំពាក់ ៥៤៥៣ លានដុល្លារអាមេរិក ដែលតួលេខនេះ ខុសពីសុន្ទរកថា របស់លោក ហ៊ុន សែន ដែលថា រដ្ឋាភិបាល ជំពាក់បរទេសជាង ២០០០ លានដុល្លារអាមេរិក។
លោក សុន ឆ័យ បានប្រាប់ រដ្ឋសភា ថា ក្រុមហ៊ុនឯកជនជាង ២០០ ក្រុមហ៊ុន បានកាន់កាប់ដីស្ទើរស្មើនឹងដីប្រជាជននៅទូទាំងប្រទេស គឺជាង ៣ លានហិកតា ខណៈប្រជាជនពី ១៧ ទៅ ១៨ ភាគរយ គ្មានដីធ្វើកសិកម្ម ហើយបានជំរុញឲ្យរដ្ឋាភិបាល ឆ្លើយតបទៅនឹងសំណើរបស់គណបក្សសម រង្ស៊ី អំពីការកំណត់ពន្ធ ៧០ ដុល្លារអាមេរិក ក្នុងមួយហិកតា ក្នុងរយៈពេលមួយឆ្នាំ លើដីសម្បទានសេដ្ឋកិច្ច និងក៏ទាមទារឲ្យតម្លើងពន្ធលើកាស៊ីណូ បង្កើនប្រសិទ្ធភាពលើការប្រមូលពន្ធប្រេង និងពន្ធពីភ្ញៀវទេសចរ ដែលចូលទៅទស្សនានៅប្រាសាទអង្គរវត្ត។

លោក ជាម យៀប តំណាងរាស្រ្តគណបក្សប្រជាជន និងជាប្រធានគណៈកម្មការហិរញ្ញវត្ថុ និងធនាគារនៃរដ្ឋសភា បានថ្លែងថា៖ «សម្តេចតេជោ ហ៊ុន សែន បានធ្វើជានាយករដ្ឋមន្រ្តីតាំងពីឆ្នាំ ១៩៨៥។ បទពិសោធ និងគតិ បណ្ឌិត សិល្បៈនៃការដឹកនាំ គ្មានគំនិតអ្វីក្រៅពីស្នេហាជាតិ ស្រឡាញ់ប្រជាជន ចង់ឲ្យប្រជាជនទទួលបានសមិទ្ធផលពីការដឹកនាំ»។
លោក គាត ឈន់ ដែលបានដឹកនាំមន្រ្តីរដ្ឋាភិបាល ៤០ នាក់ ដើម្បីការពារសេចក្តីព្រាងច្បាប់ថវិកាជាតិនេះ បានថ្លែងឲ្យដឹងថា សេចក្តីព្រាងច្បាប់ថវិកាជាតិឆ្នាំ ២០១៣ នេះ ត្រូវបានចង្អុលបង្ហាញ និងគាំទ្រដោយលោក ហ៊ុន សែន។ លោកបានបន្ថែមថា អនុសាសន៍ពីគណបក្សប្រឆាំង ដើម្បីធ្វើវិសោធនកម្ម លើសេចក្តីព្រាងច្បាប់នេះ ដែលបានលើកឡើង ប្រាប់គណបក្សកាន់អំណាច គឺជាគោលបំណងរបស់គណបក្សប្រឆាំង ចង់ឡើងឋានសួគ៌ឆាប់ៗ ប៉ុន្តែលោកមិនបានពន្យល់ឲ្យបានច្បាស់អំពីអត្ថន័យ «ឡើងឋានសួគ៌ឆាប់ៗ» នោះទេ ហើយគណបក្សប្រឆាំង បានហៅការលើកឡើងរបស់លោកគាត ឈន់ បែបនេះថាជាការ«ជេរប្រមាថដោយប្រយោល»។

making money, government lawmakers insisted in parliament yesterday
when drilled about their opposition to raising gambling taxes.
Seizing on an off-the-cuff comment made by Prime Minister Hun Sen during a speech in August, Finance Minister Keat Chhon rejected opposition Sam Rainsy Party whip Son Chhay’s proposed 50 per cent tax on the net profit of casinos in Cambodia.
“[The reason] why we established casinos along the border primarily was not to collect income. This, Samdech Techo [Hun Sen], had said already is to defend our border territory,” Kean Chhon said.
In Hun Sen’s August speech, he said that though he did not like casinos, they were imposing structures that helped bolster Cambodia’s territorial defence.
Chhay claims that by taxing the more than 50 casinos in Cambodia at a rate of 50 per cent of net profit – a relatively low rate compared to major gambling destinations such as Macau and Singapore – Cambodia would generate US$189 million.
The SRP and the ruling Cambodian People’s Party were once again sparring in the house over government borrowing, with Chhay pushing for his casino tax along with a $70 per hectare tax on economic land concessions, which he says would bring in about $400 million.
He put Cambodia’s foreign debt at $7.3 billion, said $900 million would be added in the 2013 draft budget and called on the government to wipe of at least $130 million of that borrowing before the bill was passed.
But Chhon was having none of it, suggesting amendments recommended by the SRP showed the opposition party wanted to “go to heaven quickly”, without explaining what he meant by that.
The SRP also pointed to alleged inconsistencies between national debt figures produced by Keat Chhon and Hun Sen.
One of six chapters in the draft 2013 budget was approved yesterday, with 83 of the 93 sitting members in the National Assembly voting “yes”.
Meanwhile, CPP lawmaker Chheang Vun, who provoked outrage when he last month labelled opposition Human Rights Party president Kem Sokha “Phnuong” – the name of an ethnic minority that is also used as an epithet to imply someone is a backward savage – made something of a qualified apology yesterday.
Vun stressed he was simply using a term from the dictionary and did not mean to cause offence.
“So, I would like our people who are the Phnoung tribe minority to tolerate me, because I have never thought to say offending our people,” said Vun, who after his racist slur last month had claimed the Phnoung did not exist.
“What I said is defended by the dictionary. If what I said was wrong, please, Ministry of Education, take the dictionary and throw it in rubbish can,” he said.
Pheap Sochea, president of the Cambodian Minority Association, said that the Phnoung want Chheang Vun to personally apologise in front of all their tribes.

ICJ schedules hearings over Cambodian, Thai disputed territory

Justice in the ongoing territorial dispute between Cambodia and Thailand
over the Preah Vihear temple and its surrounding area.
The hearings at The Hague, in the Netherlands, will run from April 15 to 19 next year.
Both countries will be allocated three sessions to present their arguments on interpretation of the ICJ’s 1962 ruling that granted Cambodia ownership of the 11th-century temple, which perches dramatically atop a 525-metre cliff near the border.
Ownership of the temple has been a contentious issue between the countries for more than a century and a flashpoint in Thai politics.
After the 1962 ruling, territorial debate between Cambodia and Thailand turned to the 17-square-kilometre area surrounding the temple.
In 2008, after UNESCO listed the Hindu temple as a World Heritage site in Cambodia, tensions at the border between Thailand and Cambodia flared.
The following years were punctuated by a series of sometimes-deadly military skirmishes that caused permanent damage to the temple.
According to a press release issued by the ICJ on Thursday, Cambodia contends that its “sovereignty over the Temple is a direct and automatic consequence of its sovereignty over the territory on which the Temple is situated”, and as such, Thailand must withdraw all military and other personnel from the vicinity.
During public hearings in May last year on Cambodia’s request for urgent provisional measures, Thailand maintained there was no dispute over the scope of meaning of the 1962 judgment and that there was no dispute.
In July this year, coinciding with an anniversary celebration of the 1962 decision, 485 Cambodian soldiers and an undisclosed number of Thai troops were redeployed from the provisional demilitarised zone set up by the ICJ after fatal clashes that killed at least 10 and displaced thousands of families in 2011.
Information Minister Khieu Kanharith told the Post yesterday the International Court of Justice had informed Cambodia about the hearing and the government had already prepared the requisite documents with the assistance of legal experts to debate the long-standing territorial sovereignty impasse.
“The most important thing is a legal, and internationally recognised, demarcation of the border,” he said.
Index shows equitable rule of law long way off

- Cambodia lags significantly in establishing a rule of law free from
corruption, the World Justice Project (WJP) Rule of Law Index shows.
The index, published last week by the international agency, ranks Cambodia as low as 94 out of 97 countries canvassed on some of the nine concepts based on four universal principles that, according to the WJP, are needed for a functioning rule of law.
These include an accountable government, security and fundamental rights, open government and regulatory enforcement, and the delivery of justice.
In last year’s survey, Cambodia ranked 66 out of the 66 countries surveyed.
In the 2012 index, the third in the annual series, Cambodia scored the lowest in the East Asia and Pacific region in nearly every category.
Globally, Cambodia was ranked 90 out of 97 countries in establishing effective limits on government power and 94th in regulatory enforcement and civil justice, according to the country profile published by the WJP.
The Kingdom stands significantly lower compared to its global and regional counterparts as an “accountable government”.
Cambodia showed strengths in some indicators for security and fundamental rights, achieving its highest scores in “absence of crime” and “civil conflict is effectively limited”.
In the other indicators for security and fundamental rights, however, the country scored relatively poorly with its lowest rank in ensuring “people do not resort to violence to redress personal grievances”.
It was the report’s findings on corruption, however, that dragged down Cambodia’s score the most.
“Cambodia is ranked lower than most other countries in the region on all dimensions.
“The overall legal and institutional environment remains quite weak, which is highlighted by low scores in key areas, including effective limits on government powers (ranking 90th); regulatory enforcement; access to civil justice; and absence of corruption (ranked 85th),” according to a WJP press release accompanying the report.
“Property rights are very weak, and police abuses remain a significant problem. On the other hand, Cambodia has lower crime rates than most countries in the low-income group,” the press release reads.
Council of Ministers spokesman Phay Siphan said the findings echoed numbers and findings of other agencies that had been floated around for years.
“What they don’t understand is that we have been reforming the government for the past five years. We, the government, feel very satisfied with the system that exists and those agencies don’t understand [the realities],” Siphan told the Post.

មេដឹកនាំ រដ្ឋាភិបាលត្រូវអនុវត្តតាមរបៀបវារៈតឹងរ៉ឹង ហើយពួកគេត្រូវយកចិត្តទុកដាក់លើកិច្ចការចំពោះមុខ។ ប៉ុន្តែ កម្ពុជា ជាកន្លែងស្រស់ស្អាត ហើយខ្ញុំសង្ឃឹមថា លោក អូបាម៉ា អាចមើលឃើញភាពស្រស់បំព្រងនេះ ហើយខ្ញុំក៏សង្ឃឹមផងដែរថា លោកនឹងវិលត្រឡប់មកជាមួយគ្រួសារដើម្បីទស្សនាអង្គរវត្ត។
ដូច ថៃ និងមីយ៉ាន់ម៉ាដែរ កម្ពុជាជាប្រទេសប្រកបដោយមនោសញ្ចេតនា ហើយខ្ញុំសង្ឃឹមថា លោកប្រធានាធិបតីបានមើលឃើញវា នៅក្នុងផ្ទៃគំនូរខាងក្រោយ ពេលលោកឈរថតជាមួយនឹងលោកនាយករដ្ឋមន្ត្រី ហ៊ុន សែន។
